เจ้าหน้าที่ตำรวจจับกุมผู้ต้องหาตามหมายจับหรือตามกฎหมายจะนำตัวผู้ถูกจับไปที่ทำการของพนักงานฝ่ายปกครองหรือตำรวจ ( สถานีตำรวจหรือโรงพัก ) พนักงานสอบสวนมีอำนาจควบคุมตัวผู้ถูกจับไว้ที่สถานีตำรวจนานที่สุด 48 ชั่วโมงนับแต่เวลาที่ผู้ถูกจับมาถึงที่สถานีตำรวจ [ 1 ] เมื่อครบ 48 ชั่วโมง หากไม่มีการประกันตัว พนักงานสอบสวนจะนำตัวผู้ถูกจับไปศาล เพื่อขอให้ศาลพิจารณาว่าจะขังหรือจะปล่อยตัวผู้ต้องหาในระหว่างการสอบสวนคดีอาญา เหตุใดต้องนำตัวผู้ถูกจับและควบคุมตัวไปพบศาล และศาลมีบทบาทอย่างไรในการพบตัวผู้ถูกจับครั้งแรก ทั้งที่คดีอาญาที่ถูกกล่าวหายังอาจเพิ่งเริ่มสอบสวน และเหตุใดจะต้องนำผู้ถูกจับและถูกควบคุมตัวไปพบศาลภายใน 48 ชั่วโมง กติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง ( ICCPR ) ที่ประเทศไทยกับอีก 172 ประเทศเป็นภาคีให้คำตอบดังกล่าว ในข้อ 9 วรรค 3 [ 2 ] บัญญัติว่า “ บุคคลใดที่ถูกจับกุมหรือควบคุมตัวในข้อหาทางอาญา จะต้องถูกนำตัวโดยพลันไปยังศาลหรือเจ้าหน้าที่อื่นที่มีอำนาจตามกฎหมายที่จะใช้อำนาจทางตุลาการ และจะต้องมีสิทธิได้รับการพิจารณาคดีภายในเวลาอันสมควร หรือได้รับการปล่อยตัวไป มิให้ถือเป็นหลักทั่วไปว่าจะต้องควบคุมบุคคลที่รอการพิจารณาคดี แต่ในการปล่อยตัวอาจกำหนดให้มีการประกันว่าจะมาปรากฏตัวในการพิจารณาคดีในขั้นตอนอื่นของกระบวนพิจารณาและจะมาปรากฏตัวเพื่อการบังคับตามคำพิพากษา เมื่อถึงวาระนั้น ” [ 3 ] หลักการดังกล่าวเคยถูกบัญญัติไว้ในรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2540 มาตรา 237 [ …
